ORDER

The petitioner, who was arrested and remanded to judicial custody on 16.12.2025, for the offences punishable under Sections77 and 308(2) of B.N.S in Crime No.216 of 2025, registered on the file of the respondent, seeks bail.

2.The case of the prosecution is that the petitioner and the victim are known to each other and the petitioner has taken photos and videos with the victim girl. It is alleged that the petitioner threatened the victim girl with the illicitly recorded video and extorted a sum of Rs.18,00,000/- from her. Hence this case.

3.The learned counsel appearing for the petitioner submitted that the petitioner and the defacto complainant loved each other and he has not threatened the defacto complainant as alleged by the prosecution. He further submitted that the petitioner has paid a sum of Rs.6,00,000/- to the victim and there is no previous case pending against the petitioner. He further submitted that the petitioner is in judicial custody from 16.12.2025, and he is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioners.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and submitted that investigation in this case is pending and mobile phone of the petitioner is seized and sent for examination. Hence opposed to grant bail to the petitioner. 2/4

6. Heard both sides and perused the materials available on record

Considering the nature of the allegations and this is a case of misusing the relationship of the victim girl and though it is stated that there is no previous case pending against the petitioner, taking note of the fact that the petitioner has extorted a sum of Rs.18,00,000/- from the victim and investigation in this case is pending, I am not inclined Court is not inclined to grant bail to the petitioner.
