Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of Certiorari calling for the records of the 1st respondent in I.D.No.1 of 2002 and quash its award dated 04.08.2003.

O R D E R

The learned counsel appearing for the petitioner submitted that both the petitioner and 2nd respondent entered into a settlement dated 24.06.2004 under Section 18(1) of the Industrial Disputes Act and as per Clause 8 of the said settlement, it has been agreed that the settlement will replace https://hcservices.ecourts.gov.in/hcservices/

the award dated 04.08.2003 passed in I.D.No.1 of 2002, impugned in the present Writ Petition and produced the copy of said settlement in a typed set of papers. In view of the same, he prays to record the settlement and close the Writ Petition. Clause 8 of the said settlement reads as follows: "8.This settlement will replace the Award of the Industrial Tribunal dated 04.08.2003 in I.D.No.1 of 2002. It is agreed that a copy of this settlement will be filed in the High Court, Madras in W.P.No.38392 of 2003 and orders shall be sought in terms of the settlement. The workmen declared that all pending cases if any will be withdrawn upon implementation of this settlement."

2.Mr.N.Swaminathan, learned counsel appearing for the 2nd respondent representing M/s.Paul and Paul, reported no instructions.
