Respondents Writ Petition is filed under Article 226 of the Constitution of India to issue a WRIT OF MANDAMUS directing the Respondents to disperse a sum of Rs. 19,80,065/-towards the arrears of pension and commutation to the Petitioners as per the G.O.Ms.No.61 dated 30.04.2015 issued in view of the 12(3) settlement arrived at under the Industrial Disputes Act, 1947 with further interest at the rate of 6% pa till the realisation of the entire amount For Petitioners : Mr.G.Pugazhenthi For Respondents : Mr.C.K.Sathish, standing counsel (transport)
ORDER
This writ petition has been filed seeking direction against the respondents to disburse a sum of Rs.19,80,065/- towards the arrears of pension and commutation to the petitioners in terms G.O.Ms.61 dated 13.4.2015 issued in view of the 12(3) settlement arrived at under the Industrial Dispute Act, 1948 and further the 4/8
interest @ 6% per annum to its realization with the entire amount. 2.Heard Mr.G.Pugazhenthi, learned counsel for the petitioner, Mr.C.K.Sathish, learned standing counsel (transport) for the respondents and perused the material available on record.
3.The learned counsel for the petitioners submitted that though the respondents had not denied the fact about 12(3) settlements, they have failed to extend the benefits arising therefrom to the petitioners.It is further submitted that the petitioners have made several representations in this regard, but the same have not been considered or culminated in any order so far.
4. The learned standing counsel for the respondents submitted that dues towards pension and commutation have already been settled in favour of the petitioners in accordance with the 12(3) settlement and there is no further claim is payable to the petitioner.
5. In such circumstances, an appropriate order needs to be passed based on the representations made by the petitioners. While considering such 5/8
representations, the respondents shall scrutinize the relevant records and ascertain whether any benefits are due to the petitioners is payable under the 12(3) settlement and the consequential Government Order issued in this regard is namely G.O.Ms.No.61 dated 13.04.2015.
6.In view of the above observation this writ petition is disposed and the respondents are directed to consider the representation of the petitioners and pass orders in accordance with law within a period of four weeks from the date of receipt of a copy of this order. No costs.
