Petition under Article 226 of the Constitution of India praying for issue of a Writ of Mandamus directing the 1st respondent to consider the petitioner's appeal dated 07.11.2016 preferred against the order of the 2nd respondent issued in Pro.Na.Ka. No. 7400/2016/B1 dated 03.10.2016 by affording opportunity of being heard to all concerned and to pass orders thereon on merits and in accordance with law, within a limited time period.

By consent, the main writ petition itself is taken up for final disposal.

The petitioner, aggrieved by the alleged mistake, in respect of patta granted in favour of one Angiah, in respect of the landed property, admeasuring to an extent of 0.00.5 hectares in S.No. 220/3A1E1, situated in Ammambakkam Village, Uthukottai Taluk, Tiruvallur District, had moved the Tahsildar, Uthukottai, for cancellation of patta granted in favour of the said Angiah and it was rejected on 03.10.2016. legality of the same, the petitioner filed an appeal before the 1st respondent on 07.11.2016 and though it has been taken on file and the petitioner was also issued with summons for his appearance on 29.11.2016 and he has also attended the enquiry, so far, no orders have been passed and therefore, came forward to file the present writ petition.

Heard the submissions of the learned counsel for the petitioner and Mr.R.S. Selvam, learned Government Advocate, who accepts notice on behalf of respondents 1 and 2. 4.

Though the petitioner prays for a larger relief, this Court, in the light of the above facts and circumstances and without going into the merits of the claim projected by the petitioner, directs the 1st respondent to consider the petitioner's appeal dated 07.11.2016 and after putting the 3rd respondent on notice, shall dispose of the same, on merits and in accordance with law, within a period of 10 weeks from the date of receipt of a copy of this order and communicate the decision taken to the petitioner as well as to the 3rd respondent. The writ petition is disposed of accordingly. No costs.
