The petitioner, who apprehends arrest at the hands of the respondent police for the offences under Sections 302 and 201 of I.P.C in Crime No.727 of 2021 on the file of the respondent Police, seeks bail.

2. It is stated that the petitioner had not appeared before the Special Court on 11.01.2024 and thereafter the petition u/s 317 of Cr.P.Canticipatory bail application had been dismissed. Therefore, nonbailable warrant was issued.

3. It is contended by the learned counsel for the petitioner that on 11.01.2024 a petition under section 317 of Cr.P.C had been filed and the learned Judge had dismissed the same.

4. Considering the facts of the case, it is seen that anticipatory petition will not lie and this petition is dismissed. However, the petitioner may appear before the concerned magistrate and file a petition to recall NBW and the Magistrate may examine consideration of the same on merits and pass orders on the same day, if records are available. 02.02.2024 smn 2/3
