ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The suo motu contempt proceedings on hand has been instituted pursuant to the orders of this Court and a notice was issued to the contemnor.

Since the contemnor/PU.Venkatessan was already convicted by this Court on the similar allegation and in imprisonment. Thus, we thought fit to refer him for observation regarding his mental health. This contemnor is habitually making false allegations against the Judiciary and the Judges. Even after punishment in earlier contempt proceedings, he continues to behave in the same manner. Therefore, we have directed the Prison Authorities to take him to the Institute of Mental Health, Chennai - 10 for assessment. 3.

The learned Additional Public Prosecutor submitted the Observation Report of the Medical Officer, Institute of Mental Health, Madras Medical College, Chennai - 10. The Medical Officer in her observation Report states as under:

"On admission, he was alert, ambulant, gave relevant replies with normal psychomotor activity. Detailed psychiatric evaluation reveals that he has Litigious paranoia towards judiciary system and psychological assessment indicates that, he has average intelligence and he is an ambivert type of person with traits suggestive of Paranoid and Anankastic Personality. At present, he is diagnosed as a case of Delusional Disorder and is on treatment in Institute of Mental Health."

In view of the fact that the contemnor is diagnosed as a case of Delusional Disorder, it becomes unnecessary for this Court to continue the contempt proceedings against such persons. Therefore, we are inclined to close the contempt petition and accordingly, the Contempt Petition stands closed.
