O R D E R

The petitioner/defacto complainant herein has filed a petition in C.M.P.No.5545 of 2013 on the file of the learned Judicial Magistrate No.4, Salem, to return the seized currency. The trial Court has passed a conditional order directing the petitioner to produce the currency before the Court, as and when required for enquiry. Challenging the said order, the petitioner has preferred the revision before this Court.

2. The main contention of the learned counsel for the petitioner is that the currency cannot be kept as it is without using it and therefore, prayed that the conditional order passed by the trial Court may be set aside.

3. When the matter was taken up for hearing, on an earlier occasion, this Court has directed the learned Government Advocate (Crl. Side) to verify the stage of the main case. The learned Government Advocate (Crl. Side) would submit that after trial, main case itself has been disposed of. Therefore nothing https://hcservices.ecourts.gov.in/hcservices/

survives in this Criminal Revision.

4. In view of the submissions made by the learned Government Advocate (Crl.Side), that the main case itself has been disposed of, nothing survives in the present criminal revision.

5. Accordingly, the criminal revision is dismissed as infructuous.
