JUDGMENT

When the second appeal came up for hearing on 20.01.2025, there was no representation for the appellants and hence the Registry was directed to post this matter under the caption "for dismissal' on 21.01.2025. When the matter is taken up for hearing today, the learned counsel appearing for the appellants submitted that he is unable to get instructions from his clients though the matter in issue has already been settled out of court. The learned counsel appearing for the respondent also confirmed that the matter is settled out of court. Both the counsels did not file a memo in this regard. Hence, the Second Appeal is dismissed for non prosecution. No costs.
