ORDER

This Writ Petition has been filed challenging the charge memo issued by the second respondent on 23.01.2015 and consequentially directing the respondent to permit the petitioner to retire from service on 30.04.2020.

2. The petitioner was working as CSR / Field Officer and he was issued with a charge memo by the second respondent on 23.01.2015. The charges pertain to the properties being purchased in the name of the wife of the petitioner without 1/3

prior permission of the Department. The petitioner has given his explanation for the charge memo. The grievance of the petitioner is that there has been absolutely no progress in the departmental proceedings for the past 5 years and the petitioner is going to attain superannuation on 30.04.2020 and therefore, there is an apprehension in the mind of the petitioner that he will not be allowed to retire. Therefore, the petitioner is challenging the charge memo issued by the second respondent by his proceedings dated 23.01.2015.

3. Heard Mr. M.S.Palaniswamy, the learned counsel for the petitioner and Mr. D. Venkatachalam, the learned counsel for the respondents.

4. Taking into consideration the facts and circumstances of the case and also the charges framed against the petitioner, this Court is not inclined to interfere with the charge memo at this stage. This Writ Petition is disposed of with a direction to the respondents to complete the departmental proceedings against the petitioner and pass final orders within a period of eight weeks from the date of receipt of a copy of this order.

5. This Writ Petition is disposed of with the above direction. No costs. Consequently, connected miscellaneous petition is also closed.
