C.M.P.No.1752 of 2023 in C.M.A.SR.No.10134 of 2023 N.MALA,J, This Petition has been filed to condone the delay of 221 days in filing the above appeal against the order dated 13.12.2021 made in M.C.O.P.No.1683 of 2018, on the file of the Motor Accidents Claims Tribunal, Special Subordinate Judge, Coimbatore.`

2. Mr.M.Muralivinoth, the learned counsel appeared for second respondent. Though notice was served to the first respondent, he has not appeared in person or through counsel before this Court. The learned counsel for the second respondent submits that he has no objection to condone the delay, but the appellant is not entitled for any interest for the delay period of 221 days.

3. The learned counsel for the appellant submits that that he is prepared to waive the interest for the delay period of 221 days.

4. Accordingly, the delay of 221 days is condoned, subject to the condition that the appellant will not be entitled to interest for the delay period of 221 days in filing the appeal.

5. Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order and post the same 'for admission'.

Accordingly, this CMP is ordered.
