Respondent Prayer: Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Declaration declaring that the resolution on subject No.59 of the meeting dated 24.11.2003 of the Dharmapuri Municipal Council resolving to remove the shop of the petitioner is invalid, unlawful and unconstitutional and consequently directing the respondent to forbear from removing the shop of the petitioner situated at Chinnaswami Naidu Street, near Rajagopal Gounder Park, Dharmapuri Town pursuant to the said resolution. When the matter is taken up for hearing, the learned counsel appearing for the petitioners submitted that the prayer sought for in these writ petitions have become infructuous and nothing survives for further adjudication in these writ petitions and he has also made an endorsement to that effect.
