Transfer Civil Miscellaneous Petition filed under Section 24 of C.P.C., to withdraw H.M.O.P. No.237 of 2019 on the file of Principal Subordinate Court, Myladuthurai and transfer the same to the file of Family Court, Ariyalur to be tried jointly along with FCHMOP No.89/2019.

O R D E R

Wife has filed the Transfer Civil Miscellaneous Petition under Section 24 of the Civil Procedure Code, seeking transfer of H.M.O.P. No.237 of 2019 from the file of Principal Subordinate Court, Myladuthurai to the file of Family Court, Ariyalur to be tried jointly along with FCHMOP No.89/2019.

2. Learned counsel for the petitioner submitted that the respondent was served about the pendency of the proceedings before this court and that the respondent has entered appearance through counsel. When the matter was taken up for hearing, there was no representation for the respondent and hence the matter was passed over, till raising of the court. But, there is no representation for the respondent, till raising of the court. Hence, this court presumes that the respondent has no serious objection for transferring H.M.O.P. No.237 of 2019 from the file of Principal Subordinate Court, Myladuthurai to the file of Family Court, Ariyalur, to be tried along with FCHMOP No.89 of 2019.

3. In view of the same, the proceedings in H.M.O.P. No.237 of 2019 is withdrawn from the file of Principal Subordinate Court, Myladuthurai and transferred to the file of Family Court, Ariyalur, to be tried along with FCHMOP No.89 of 2019. The Family Court, Ariyalur, is expected to conclude the trial, as expeditiously as possible, without adjourning the matter beyond 45 working days at any point of time, to bring the issue to a logical end.

4. The Transfer Civil Miscellaneous Petition is allowed as indicated above. No costs. Consequently, the connected C.M.P.No.2527 of 2020 is closed.
