This Criminal Original Petition has been filed to modify the condition imposed in Crl.M.P.No.6059 of 2024, by the learned Principal Special Judge, the Principal Special Court Under EC & NDPS Act, Chennai, dated 27.06.2024.
2. The learned counsel for the petitioner submitted that, the petitioner was arrested and remanded to judicial custody on 07.05.2024, for the offences punishable under Sections 8(c) r/w. 20(b)(ii)(B), of the NDPS Act, and the bail was also granted to the petitioner on 27.06.2024, in Crl.M.P.No.6059 of 2024, by the learned Principal Special Judge, Chennai, and imposed one of the condition, that the petitioner shall execute a bond for Rs.10,000/- along with two acceptable and reliable sureties likesum. One among sureties shall be a Government servant to the satisfaction of the learned IX Metropolitan Magistrate, Saidapet. He would submit that the petitioner does not have any capacity to produce the government servant surety and for that reason, being released on bail, the petitioner was still not able to come out of the prison. Hence, he prayed for the modification of the order dated 27.06.2024, in Crl.M.P.No.6059 of 2024.
3. The learned Government Advocate (Cril.Side) would submit that bail was granted to the petitioner on 27.06.2024, by the learned Principal Special Judge, Chennai, dated 27.06.2024, by imposing a condition that one among sureties shall be a Government servant.
4. Heard the learned counsel for the petitioner, the learned Government Advocate (Crl.Side) and perused the materials available on record.
5. It is seen that the petitioner has approached this court without filing appropriate application before the concerned Court, which has passed the order. Accordingly, this Criminal Original Petition is dismissed, granting liberty to the petitioner to approach the concerned court.
