Respondent PRAYER : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, praying to set aside the order of the Bailable Warrant issued as against the petitioner/accused in C.C.No.154 of 2015 on 22.04.2016 for the offence under Section 138 of Negotiable Instruments Act,1881 by the learned Judicial Magistrate, Fast Track Court, Coonoor. O R D E R

This Criminal Original Petition has been filed, seeking to set aside the order of the Bailable Warrant issued as against the petitioner/accused in C.C.No.154 of 2015 on 22.04.2016 for the offence under Section 138 of Negotiable Instruments Act,1881 by the learned Judicial Magistrate, Fast Track Court, Coonoor. 2.Mr.A.B.Ashok, the learned counsel appearing for the petitioner would submit that since the date of hearing was originally fixed on 07.04.2016 but the summons to the petitioner/accused was served only on 09.04.2016. Hence, the petitioner was not in a position to appear before the learned Judicial Magistrate, Fast Track Court, Coonoor, on the other hand, Bailable Warrant has been issued. It is further submitted that the petitioner is inclined to appear on the next hearing https://hcservices.ecourts.gov.in/hcservices/

date, which falls on 14.06.2016.

3.Recording the submission made by the learned counsel appearing for the petitioner, this Criminal Original Petition is disposed of, by directing the petitioner to appear before the learned Judicial Magistrate, Fast Track Court, Coonoor, on 14.06.2016, which is the next hearing date. Till such time, the Bailable Warrant issued as against the petitioner/accused shall be kept in abeyance.
