Prayer:- Criminal Original Petition filed under Section 482 Cr.P.C to delete the condition of depositing Rs.50,000/- each to the satisfaction of the learned Judicial Magistrate No.1, Dharmapuri imposed in the order of anticipatory bail of the petitioners in Crl.M.P.No.873 of 2016 dated 11.5.216 on the file of the Vacation Sessions Judge, Dharmapuri.

O R D E R

Seeking to delete the condition of depositing Rs.50,000/- (Rupees fifty thousand only) each to the satisfaction of the learned Judicial Magistrate No.1, Dharmapuri imposed on the petitioner in Crl.M.P.No.873 of 2016 on the file of the Vacation Sessions Judge, Dharmapuri dated 11.05.2016, the petitioner has come up with this petition.

2. The learned counsel appearing for the petitioners would submit that the petitioners are poor and daily wage cooly workers and hence they find it very difficult to pay such a huge amount.

3. The learned Government Advocate (Crl.Side) would submit that totally 26 accused are involved in this case and the petitioners along with the other accused have damaged the forest property, ie., sandalwood trees etc., worth about Rs.10,00,000/-.

4.Considering the facts and circumstances of the case and the fact that the petitioners are poor coolies, this Court is inclined to modify the condition to the effect that the each of the petitioners shall deposit a sum of Rs.10,000/- (Rupees ten thousand only) to the satisfaction of the learned Judicial Magistrate I, Dharmapuri.
