Application praying that this Hon'ble Court be pleased to Reject the Plaint in C.S.No.242 of 2019 as it is not maintainble with exemplary costs.
This Application having been heard on 09.12.2020 in the presence of Mr. T.Mohan for Mr.Cibi Vishnu, Advocates for the applicant herein and Mr.P.V. Balasubramanian for Mr. S.Ranjith Kumar, Advocates for the respondents herein and upon reading the judge's summons and the affidavit of M.P.Singh filed herein and having stood over for consideration till this date and coming on this day before this court for orders in the presence of the said advocates for the parties hereto and this court having observed that objection as to jurisdictional issue cannot be raised ar this stage when the jurisdiction to entertain the suit is approved by the Apex Court and time frame is also fixed to dispose the suit and it is also well settled that objection as to place of suing should have been raised at the earliest possible opportunity, whereas in this case even when interim orders were challenged upon the Hon'ble Apex Court
no objection as to place of suing ever raised, and in such a view of the matter the contention of the applicant cannot be countenanced, it is ordered:- That the A.No.453 of 2020, be and is hereby dismissed.
