The petitioner, who apprehends arrest for the alleged offences punishable under Sections 120(B), 147, 148, 294(b), 427, 506(2) and 302 of I.P.C in Crime No.297 of 2022, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that due to previous enmity between the husband of the defacto complainant/deceased, the petitioner along with other accused attacked the deceased with iron road and thrown him away. The deceased sustained grievous injuries all over the body and died on the spot itself. Hence the complaint. 3.The learned counsel for the petitioner would submit that only based on the confessions statement made by the co-accused the petitioner has been implicated in this case. He further submits that he was present at the scene of occurrence, that apart he has not committed any offence as alleged

by the prosecution. Hence prays for grant of anticipatory bail to the petitioner.

4.The learned Government Advocate (Crl.Side) would submit the petitioner along with other accused attacked the deceased with iron road and caused severe blood injury and head injury, due to which the deceased died on the spot itself. Hence he vehemently opposed for grant of anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and the nature of offence committed by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, the Criminal Original Petition is dismissed. 01.02.2023 smn
