Writ petition filed under Article 226 of the Constitution of India praying this Court to issue a writ of Mandamus, directing the 2nd respondent - Disciplinary Authority to nominate any other Civilian Officer to conduct the disciplinary proceedings against the petitioner only by following the procedure laid down in Rule 17(b) of the Tamilnadu Civil Services (Discipline and Appeal) Rules strictly complying with the principles of Natural Justice and the relevant rules ensuring fairness in the enquiry within a time frame fixed by this Court.

ORDER

When the matter was taken up today for hearing, Mr.Sathiachandiran, learned counsel appearing for petitioner submits that during the pendency of the writ petition the petitioner has obtained voluntary retirement from service (VRS) on 30.09.2019 and therefore, nothing survives for consideration in this petition and the the prayer made in this petition has become infructuous.

2.Recording said submission made by the learned counsel appearing for petitioner, this writ petition is dismissed as infructuous. However there shall be no order as to costs.
