PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to call for the records pertaining to the proceedings in the FIR No.20 of 2023, on the file of the Inspector of Police AWPS Thirukoilur and quash the same. ORDER

This petition has been filed to quash the FIR in Crime No.20 of 2023, pending on the file of the 1st respondent.

2.When the matter was taken up for hearing, the learned Government Advocate (Crl.Side) submitted that the investigation has been completed and draft final report is also ready to be filed before the concerned jurisdictional Court. This Court also had the advantage of going through the draft final report along with all the statements recorded under Section 161 Cr.PC.

3.In view of the above, the relief as sought for in this petition cannot be granted by this Court. There shall be a direction to the 1st respondent to file final report before the concerned jurisdictional Court within a period of four weeks from the date of receipt of copy of the order. If ultimately the final report is acted upon and summons is issued to the petitioners and they have some grievance, it is left open to the petitioners to work out their remedy in the manner known to law. On the other hand, if the petitioners are able to arrive at some settlement with the de facto complainant, it is left open to them to file a quash petition on the ground of compromise.
