Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorarified Mandamus, to call for the records pertaining to the order No.TEL/PL/05/DISC/02/2004, dated 10.01.2004 of the first respondent as confirming the order of dismissal dated 28.04.2003 passed by the second respondent in PL/DISC/0523/03 and quash the same and consequently direct the respondents to reinstate the petitioner with backwages, continuity of service and with other attendant benefits.

O R D E R

Challenging the order of dismissal dated 28.04.2003 of the first respondent, the petitioner is before this Court.

2. The learned counsel for the respondents would submit that the petitioner has received all his terminal benefits from the respondents and in proof of that, the full and final https://hcservices.ecourts.gov.in/hcservices/

settlement made in favour of the petitioner on 01.08.2003 has been produced.

3. However, the learned counsel for the petitioner would submit that he could not get any instructions from his client.

4. Since the petitioner is 63 years of age now and there was no instruction with regard to the full and final settlement made by the respondents, to the learned counsel for the petitioner, this Court, recording the submissions made by the learned counsel for respondent is inclined to dismiss the writ petition as infructuous. Accordingly, the writ petition is dismissed as infructuous. However, it is open to the petitioner to restore the same, in case of non-settlement of terminal benefits. No costs.
