ORDER
The writ petition is filed challenging the Government Order in G.O.No. L-30012/41/2003-IR(M), dated 27.11.2003. By the order impugned in the writ petition, the question referred therein in the schedule is as to whether the non-employment of 155 workers by the management of Chennai Petroleum Corporation Limited, through the new contractor, Shivas Industrial Caterers India Private limited is justified, if not, to what relief they are entitled to.

When the matter came up for hearing, the learned counsel appearing on behalf of the workmen would submit that in this case, it seems to him that there were some connected issues which were taken up in the claim petitions under Section 33C(2) of the Industrial Disputes Act and while settling the workmen's claim, all the issues were settled and practically no issue is left between the workmen and the management.

Per contra, the learned counsel appearing on behalf of management would submit that this is a reference which is made pursuant to which the industrial dispute is pending in I.D.No. 297 of 2004 before the Central Government Industrial Tribunal, Chennai and therefore, it cannot be said that the matter is settled.

4. Be that as it may, the said factor, whether anything remains or not can also be looked into by the Industrial Tribunal. In this writ petition, this Court is concerned about the validity of the Government Order referring the issue to the Industrial Tribunal. The grounds raised by the petitioner to question the order of reference are that, they cannot be considered as the principal employer and adding them as a party to the dispute is erroneous. It is now well settled that the said contentions relate to the merits of the matter and the same cannot be gone into by the Government at the time of referring the matter. It would be very well open to the petitioner management to raise this ground before the Industrial Tribunal and Industrial Tribunal will consider the same on its own merits.
5. Accordingly, finding no merits with reference to the challenge made to the Government order and keeping it open to the petitioner management to raise all the grounds in the pending Industrial Dispute, this writ petition is disposed of. No Costs.
