The writ petitioner has filed this writ petition to call for the records relating to the order in C.P.No.11/98, dated 29.10.2002 passed by the second respondent herein and quash the same and further direct the second respondent to compute the claim petition in No.11/98.

2. Today, when the matter was taken up for hearing, learned counsel for the petitioner filed a Memo dated 20.03.2023 before this Court, stating that he has no instructions from the petitioner. For better appreciation, the relevant paragraph of the said Memo is extracted hereunder: "The above writ petition was filed by Mr.K.Vasudevan, Advocate, who had expired on 18.01.2018. Mr.K.M.Ramesh, Senior Advocate, was representing the cases pertaining to late Mr.K.Vasudevan after his demise. The case bundle relating to the above writ petition was not handed over to Mr.K.M.Ramesh. However, after noting down the address of the petitioner, letter was sent to the petitioner Tmt.A.Venda from the office of Mr.K.M.Ramesh. But the petitioner has not respondent and chose to contact the office of Mr.K.M.Ramesh. In view of the above, it is reported "No instructions" before this Hon'ble Court".

3. Recording the Memo dated 20.03.2023 submitted by the learned counsel for the petitioner, this writ petition is dismissed for non-prosecution with a liberty to the petitioner to re-open the same, if the need arises. No costs.
