Crl.O.P.No.10951 of 2016 R.MAHADEVAN.J , The petitioners who were arrested on 05.05.2016 for the alleged offences punishable u/s.147, 148, 294(b), 332, 323, 324, 307 and 506(ii) IPC in Cr.No.135/2016 on the file of the respondent police, seek bail.

The case of the prosecution is that when the petitioners were standing nearby a TASMAC shop with their two wheelers, a wordy quarrel arose between the petitioners and the defacto complainant, who is a police Head Constable and the petitioners are alleged to have attacked the defacto complainant and a Senior Sub Inspector of Police and caused injuries to them.

3. The learned counsel for the petitioner submitted that the petitioners have not committed any such offence and they have been falsely implicated in this case.

4. The learned Additional Public Prosecutor submitted that the injured have sustained serious injuries and they have been discharged from the hospital.

5.Considering the facts and circumstances of the case and also considering the fact that the petitioners are undergoing incarceration right from 05.05.2016, this court is constrained to release them on bail. Accordingly, the petitioners are released on bail on each of them executing a bond for Rs.10,000/-(Rupees ten thousand only) with two sureties, each for a like sum to the satisfaction of the learned District Munsif cum Judicial Magistrate, Needamangalam and on further condition that the petitioners shall stay at Kumbakonam and appear before the Inspector of Police, Kumbakonam Town Police Station daily at 10.00 a.m. for a period of two weeks and thereafter, as and when required by the respondent police, for interrogation.
