J U D G M E N T

(Judgment of the Court was delivered by S.M.Subramaniam,J.) The present intra Court Appeal has been instituted, challenging the Writ Court order dated 04.11.2025 passed in W.P.No.41210 of 2025.

2. State has preferred the present writ appeal mainly on the ground that terminal benefits due to the 1st respondent have not been settled due to financial constraint. Such a ground taken is untenable, since salary, other expenditures and benefits are borne by the Establishment on regular basis and a retired employee is entitled to get benefits without any delay.

3. In the present case, it is brought to the notice of this Court that the amount due to be paid to the 1st respondent is about a sum of Rs.1,12,000/-. That being the factum, this Court does not find any infirmity in respect of the Writ Order impugned. That apart, 1st respondent / employee retired from service as early as on 31.07.2015. Benefits due to him have not been settled to him for about 11 years.

4. Thus, the appellant and the 2nd respondent are directed to settle the terminal benefits and other benefits due to the 1st respondent along with interest within a period of four weeks from the date of receipt of a copy of this judgment.

With the above direction, the present Writ Appeal stands dismissed. No costs. Consequently, connected Miscellaneous Petition is closed.
