... Respondents This case came up for settlement before the National Lok Adalat. Both the parties are present. Mr.T.S.Arthanareeswaran, the learned counsel for the Appellant(s) and Mr.R.V.Sivaraj, the learned counsel for the 2nd respondent(s) are present. The 1st respondent was set exparte before the Tribunal. After mutual discussion, negotiation, mediation and conciliation between both the parties, they arrived at a compromise to settle the matter as follows:-
TERMS OF SETTLEMENT The appeal has been preferred by the claimants, aggrieved by the award of Rs.3,30,000/- (Rupees Three Lakhs Thirty Thousand only) together with interest. The 2nd respondent Insurance Company has already deposited the award amount of Rs.3,30,000/- together with applicable interest. 2.Today, the parties have decided to amicably settle the matter and have arrived at an additional sum of Rs.8,00,000/- (Rupees Eight Lakhs only) in full quit. 3.The 2nd respondent/Insurance Company is directed to deposit the additional award amount of Rs.8,00,000/- (Rupees Eight Lakhs only) to the credit of M.C.O.P.No.189 of 2012, within a period of eight weeks, from today. On such deposit, the appellants are entitled to Rs.4,00,000/- each. The appellants are permitted to withdraw their additional compensation award, without filing any formal petition, before the competent Court. No order as to costs in this appeal, award is passed accordingly.
