Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the second respondent to consider the petitioner's representation dated 07.06.2010 in accordance with law.
For Petitioner : Mr.S.K.Chandra Kumar For Respondents : Mr.S.Ravichandran Additional Government Pleader for R1 to R 5 Not ready in notice for R6 to R38
ORDER
The relief sought for in the present writ petition is to direct the respondents to consider the representation submitted by the writ petitioner on 07.06.2010.
2. The representation submitted by the petitioner reveals that 92 families claim free land patta from the revenue authorities. However, the authorities have granted patta to 54 families and therefore, they have submitted a representation to grant patta in respect of the 38 families.
3. The representation was sent in the year 2010 and 13 years lapsed. At this length of time, this Court cannot direct the authorities to consider the representation. More so, granting of free land patta is to be considered based on the scheme, if any prevailing, and therefore, it cannot be claimed as a matter of Right. If at all any scheme for grant of free patta is in force, then the petitioners are at liberty to submit an application before the competent authority for the purpose of getting the benefit.
4. In view of the fact that the petitioners have not established any right, the relief as such sought for in the present writ petition cannot be
granted. With these observations, the writ petition is dismissed. There will be no order as to costs. Consequently, the connected miscellaneous petition is closed.
