Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, seeking issuance of a writ of certiorarified mandamus, to call for the records relating to the impugned order passed by the 1st respondent herein in his proceedings Letter No.1827/SC2(1)07-6, dated 13.09.2007 and quash the same and consequently direct the respondent to allot No.G SIDCO Housing Quarters, Ambathur Industrial Estate to the petitioner.

Heard Mr.Gini Liew Manuel, learned counsel for the petitioner, Mr.B.Anand, learned Government Advocate for the first respondent, Mr.S.Yaswanth, learned counsel for the second respondent and perused the materials available on record.

2. Assailing the order of the first respondent dated 13.09.2007, the present writ petition has been filed.

3. It seems that the petitioner's father Mariyanathan was working as a head constable in Korattur Police Station and a quarters No.A-5 was allotted to him on rental basis. Subsequently, the police department constructed new police https://hcservices.ecourts.gov.in/hcservices/

quarters and a house was allotted to the said Mariyanathan there. Since the old quarters was not surrendered, the impugned proceedings were initiated.

4. In the counter affidavit filed by the second respondent particularly in paragraph No.9, it has been stated that in pursuance of the order impugned in this writ petition, the quarters was taken possession and sealed by SIDCO in the presence of the Village Administration Officer and Police Officials on 08.03.2008.

5. Taking note of the above fact and the counter filed by the second respondent, this Court is of the considered opinion that nothing survives for adjudication in this writ petition. Accordingly, the writ petition stands dismissed. However, there shall be no order as to costs.
