This petition is filed to quash the proceedings pending in S.T.C.No.1615 of 2016 on the file of Judicial Magistrate, Tambaram.

2. When the matter is taken up for hearing, there is no representation for the respondent.

3. Learned counsel for the petitioner submits that she may be permitted to withdraw the criminal original petition with liberty to raise all the defences before the trial Court. She also submits that the petitioner is a heart patient and prays that he may be permitted to appear before the trial Court as and when his presence is required by the trial Court. It is also submitted that a sum of Rs.2,00,000/-was deposited as per the direction of this Court.

4. In view of the reasons stated and endorsement made by the learned counsel for the petitioner, the Criminal Original Petition is dismissed as withdrawn. The presence of the https://hcservices.ecourts.gov.in/hcservices/

petitioner may be insisted by the trial Judge as and when the presence of the petitioner is absolutely necessary and he need not be required to be present on every hearing. Consequently, connected miscellaneous petitions are closed.
