Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of Mandamus directing the first respondent herein to consider the petitioner's representation dated 26.12.2017 and to conduct enquiry and to take necessary criminal action as against the third respondent and 6 unnamed policemen attached to the second respondent police station and consequently to direct them to jointly pay compensation of sum of Rs.5 lakhs to the petitioner's husband for them indulging in unlawful acts. The limited prayer sought for in the present Writ Petition is for a direction to the first respondent to consider the petitioner's representation dated 26.12.2017, wherein she had complained of physical torture by the second and third respondent.

2.It is needless to point out that whenever complaint of this nature is made, the same cannot be kept pending indefinitely but needs to be disposed of in one way or other. Since the representation pertains to physical beating by the police officials belonging to the second respondent police station, it would be proper that the enquiry be conducted by a higher official and a decision be taken thereon. https://hcservices.ecourts.gov.in/hcservices/

3.The Assistant Commissioner of Police, Poonamallee, Chennai is suo motto impleaded as party respondent. Consequently, the petitioner's representation dated 26.12.2017 is directed to be forwarded to the Assistant Commissioner of Police, Poonamallee, Chennai, within a period of one week from the date of receipt of a copy of this order and on receipt of the said representation, the Assistant Commissioner of Police, Poonamallee shall consider the same on his own merits and pass appropriate orders within a period of six weeks from the date of receipt of the said representation.

4.With the above observation and direction, the Writ Petition stands disposed of. No costs.
