A.No.560 of 2021 in C.S.No.499 of 2010 N.SESHASAYEE, J., In the course of the cross examination of the plaintiffs, the 1st defendant has produced family arrangement, whose marking was opposed on the ground of stamp duty. Hence, the applicant has filed an application for a direction that he may be permitted to mark the family arrangement, after paying necessary deficit stamp duty along with penalty payable thereon. Representing counsel appeared on behalf of the plaintiff and submitted that the counsel for the plaintiff is indisposed and seeks some time.

2. The nature of the prayer sought is very short and it only involves grant of paying deficit stamp duty along with penalty payable thereon. In this, the plaintiff has no role.

3. This petition is allowed subject to payment of deficit stamp duty.
