Writ of Certiorarified Mandamus calling for the records comprised in the proceeding of the 1st respondent in his proceedings bearing No.JJA 5/15/94 dated 31/7/2006 and quash the same and consequently issue a mandamus by directing the respondents to execute the sale deed in favour of the petitioner with respect to shop No.9 JJ Nagar West Mogappair West Chennai 37 after refunding the excess amount of Rs.31 500/- lying with the 2nd respondent along with interest.
Order:This Petition coming on for hearing on this day, and upon perusing the petition and the affidavit filed in support thereof on the file of the High Court and upon hearing the arguments of Mr.R.Parthasarathy, Advocate for the Petitioner and Mr.R.Bharath Kumar, Advocate for the 1st Respondent, this court made the following order:
The learned counsel appearing on either side shall submit a calculation memo. The learned counsel for the petitioner shall indicate the payments made by the petitioner and satisfy this Court as to how the entire payments have been made by the petitioner within time. The Housing Board shall also file a calculation memo and justify the impunged demand letter issued on
13.07.2006. If there is any other amount due and payable as on date, the same shall also be included in the calculation memo. The learned counsel appearing on either side shall exchange the calculation memo before the next date of hearing. Post this case on 23.06.2022.
