Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to consider the petitioner's request dated 22.01.2024 and her representation dated 24.01.2024 and transfer her to the place of her choice based on the transfer counselling for the year 2024 or subsequently, with all attendant service benefits.

ORDER

This Writ Petition has been filed in the nature of a Mandamus seeking a direction against the respondents to consider the representation given by the petitioner on 24.01.2024, by which representation, she had sought transfer to the place of her choice. She had attended the transfer counselling in the year 2024.

2.In the affidavit filed in support of the writ petition, it had been stated that the writ petitioner is now serving as Vice-President in IRT, School of Nursing at Perundurai in Erode District. The IRT institution has now been taken over by the Health and Family Welfare Department, Government of Tamil Nadu and it come under the Erode Government Medical College. It is stated that the petitioner had sought transfer to Chengalpet Medical College. Her husband is working in Chengalpet.

3.On the side of the respondents, instructions had been obtained, wherein it had been stated that the petitioner had given a request letter on 24.01.2024. It had also been stated that no Disciplinary Proceeding is pending or contemplated against the petitioner herein. 4.In view of all these facts, a direction is given to the 2nd and 3rd respondents to examine the representation given by the petitioner and if required give an opportunity of being heard, since, as a lady, she seeks that she may be transferred to the place of her choice and thereafter, pass appropriate orders in accordance with the rules and guidelines. Necessary orders in this regard may be passed within a period of six weeks from the date of receipt of a copy of this order or if the transfer counselling is to be held in April 2025, during the counselling session. 5.With the above observations, this Writ Petition stands disposed of.
