3.Offences alleged in the petition are under Sections 294 (b), 323 and 506(i) IPC. But the offences alleged in the FIR are u/s.294(b) and 323 IPC.
4.Since the offences registered now are bailable offences, the petitioner cannot invoke Section 438 Cr.P.C. 5.In such case, bail is rule and jail is an exception, unless he offers bail. In other words, if he refuses bail, then, no bail even in bailable offences.
