Respondent PRAYER: The Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus or order or direction more in the nature of Writ of Mandamus directing the respondent to consider selecting and appointing the petitioner who belong to MBC category and secured 31.744 marks to the post of Technical Assistant-Electrical under 'Priority Basis' pursuant to the Notification No.01/2016 dated 28.02.2016 issued by the Tamil Nadu Generation and Distribution Corporation Limited. 1/6

O R D E R

This Writ Petition has been filed for the issue of a Writ of Mandamus directing the respondents to consider the representation made by the petitioner wherein the petitioner has sought for considering his name for appointment to the post of Technical Assistant- Electrical under the priority quota basis.

The case of the petitioner is that when notification came to be issued by the respondent in the year 2016 calling for applications from all eligible candidates for appointment to the post of Technical Assistant- Electrical, the petitioner also applied for the said post. The petitioner wrote the written examination and he was called for the oral test and ultimately the petitioner secured 31.773 marks out of 100. The petitioner had applied under the priority quota basis. However, the petitioner was not able to produce the relevant certificate and hence the candidature of the petitioner was not considered. 2/6

The cause of action for filing the present Writ Petition is that now the petitioner is able to get the relevant priority quota certificate issued by the competent authority and hence he had made a representation to the respondent seeking for appointment to the post of Technical Assistant-Electrical. Since the same was not considered, the present Writ Petition has been filed.

4. Heard Mr.V.Balamurugane, learned counsel appearing for the petitioner and . Mr.K.Rajkumar, learned standing counsel appearing for the respondents.

In the considered view of this Court, the petitioner had participated in the selection that was conducted in the year 2019 and by now all the posts had been filled up and the petitioner obtaining the priority certificate subsequent to the selection will not help the petitioner to be considered for the previous selection, which has already been completed. At the best, the petitioner can utilize the said certificate if any subsequent applications are called for by issuing a notification and if the petitioner fulfils all the other conditions. 3/6

6. This Court does not find any merit in this Writ Petition and accordingly, the same is dismissed. No Costs. 01.02.2023 Speaking Order/Non-Speaking Order.
