JUDGMENT

(Judgment of this Court was delivered by M.S.RAMESH.J) The prayer in the Writ Petition was for issuance of a Writ of Mandamus, directing the TNPSC to select and appoint the petitioner therein to the vacant post of Agricultural Officer under BC Muslim category. The Writ Petition came to be disposed of on 24.03.2021, as against which, the present Writ Appeal has been filed.

2. Learned counsel for the appellant / TNPSC submitted that on 31.01.2024, the respondent was appointed as an Agricultural Officer under BC Muslim category as per G.O.(Ms).No.31, Backward Classes, Most Backward Classes and Minorities Welfare (BCC) Department, dated 09.03.2024 and she is now continuing her services.

3. Learned counsel for the respondent submitted that the recruitment notification was in the year 2018 and, therefore, the seniority of the respondent ought to be reckoned from the date on which similarly placed persons were appointed under the said notification.

4. We are not be in a position to entertain such a plea at this stage,

since such a prayer was not made before the learned Single Judge when the Writ Petition came to be disposed of. In this background, we are not inclined to render any of our views on the plea made. However, liberty is granted to the respondent herein to workout her remedies before the authority concerned, in accordance with law.
