J U D G M E N T
(Judgment of the Court was made by S.M.SUBRAMANIAM, J.) The learned Senior Counsel, Mr.Ajmal Khan, appearing on behalf of the second respondent would submit that the agreement came to an end on 05.07.2021 itself. The said agreement was not extend any further and therefore, the cause did not exist and no further adjudication needs to be undertaken.
2. The writ order impugned also shows that the continuation of the agreement cannot be claimed by the appellant/ writ petitioner as a matter of right. It is left to the discretion of the second respondent to either renew the agreement or to decide not to renew the same. The writ court held that the High Court, in exercise of its jurisdiction under Article 226 of the
Constitution of India, cannot direct the extension of the licence period.
3. In view of the submissions made by the learned Senior Counsel for the second respondent and considering the fact that the expiry of the agreement was well considered by the writ court, no further adjudication needs to be undertaken.
4. The learned counsel for the appellant would submit that he has given change of vakalat and it is brought to the notice of this court that the appellant company has been taken over by the resolution applicant under the Insolvency and Bankruptcy Code, 2016. That being so, the writ appeal stands closed. No costs. Consequently, connected miscellaneous petition is closed.
