Respondents Prayer : Petition filed under Article 226 of Constitution of India praying for issuance of a Writ of Certiorarified Mandamus calling for the records connected with (i) the order passed by the first respondent in B.P.No.103 TWAD (Estt. Per) Wing dated 29.07.2002 revising the scale of pay for the petitioner Superintendents as Rs.1700-60-2480-75-3005 and consequently withdrawing the 5% personal pay to them and (ii) the subsequent
order passed by the second respondent in Letter No.99189/Estt (Personal) Wing / A1/2002 dated 23.05.2003 stating that the stay granted by the Hon'ble Tamil Nadu Administrative Tribunal is not applicable with regard to the revision of pay scale for the petitioner Superintendents and (iii) the subsequent order of recovery passed by the third respondent in Proc.NO.F28/EA/2004/dated 28.01.2004 and quash the same and further direct the respondents to revise the scale of pay for the petitioner Superintendents and fix next appropriate higher scale of pay to the scale of pay Rs.1640-2900 from the Pay Structure recommended by the Vth Pay Commission and accepted by the Government of Tamil Nadu in Appendix I of the Tamilnadu Revised Pay Rules, 1989 from 01.06.1988 onwards and also to revise the corresponding and appropriate scale of pay from the Pay Structure recommended by the VIth Pay Commission and accepted by the Government of Tamilnadu in Schedule I and II of the Tamilnadu Revised Pay Rules, 1998 from 01.01.1996 onwards duly allowing all monetary benefits thereon.
