Respondents Prayer:- Writ Petition filed under Article 226 of the Constitution of India, 1950, praying to issue a Writ of Mandamus, directing the Respondents to pay the emoluments/reimburse the monies to the tune of Euros 41916 (i.e. Euros 998 x 42 months) which is equivalent to Rs. 32,12,283/- (Rupees Thirty Two Lakhs Twelve Thousand Two Hundred and Eighty Three only) (the value of Euro to INR calculated as per the currency rate prevalent as on 31.12.2014, i.e. 1 Euro = 76.6362 INR) deducted towards social security contributions during the Petitioner's tenure as DGM-Paris for the period from May 2011 to December 2014, along with interest at the rate of 12%from December 2014 till the date of realization by considering the Petitioner's earlier representations and 1/4

representation dated 15.09.2021.

Since it is contended by the Respondents that the Respondents is not 'State' within the meaning of Article 12 of the Constitution for prosecuting the Writ Petition, Learned Counsel for the Petitioner seeks permission of the Court to withdraw the Writ Petition with liberty to file a civil suit before the jurisdictional Court for relief claimed and he has made an endorsement to that effect in the court record.

In view of the same, the Writ Petition is dismissed as withdrawn granting such liberty. No costs.
