ORDER
This Criminal Original Petition has been filed to withdraw and transfer the M.C.No.9/18 pending before the Family Court, Puducherry to Principal District Court, Cuddalore.
2. The learned counsel appearing for the petitioner seeks permission of this Court to withdraw this petition. He also submitted that the petitioner is in Dubai and he is working as a driver. Therefore, he could not appear before the Trial Court on each and every hearing. As such, he seeks for dispense with.
3. Considering the submission made by the learned counsel for the petitioner, the personal appearance of the petitioner is dispensed with and he shall be represented by a counsel after filing appropriate application. The petitioner shall be present before the Court at the time of furnishing of copies, framing charges, questioning under Section 313 Cr.P.C. and at the time of passing judgment. 4. Accordingly, this Criminal Original Petition is dismissed as withdrawn.
