The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 115(2), 118(1) and 351(3) of BNS, 2023 in Crime No.295 of 2025, on the file of the respondent Police, seek anticipatory bail.
2. The allegation against the petitioner is that on 13.12.2025 at 8.p.m., due to matrimonial dispute, petitioner abused the defacto complainant and also assaulted with iron rod, due to which, defacto complainant sustained injuries. Hence, the case.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case and he further submitted that, due to matrimonial dispute, false complaint has been given. Hence, he prayed for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that, injured has been discharged from the hospital. He further submitted that, apart from this case, petitioner has one previous case. Hence, he opposed for grant of anticipatory bail to the petitioner.
5. Though, injured was discharged from the hospital, considering the nature of injuries and the bad antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
6. Accordingly, this Criminal Original Petition is dismissed. 27.01.2026 sma
