This petition has been filed seeking to condone the delay of 94 days in filing the appeal.

Learned Special Public Prosecutor appearing for the petitioner/appellant submitted that though the Registry has calculated the delay as 94 days, if the appeal is considered under Section 378(5) of Cr.P.C, the period of limitation is six months, since the case arises out of a private complaint. Therefore, the actual delay would only be 5 days.

3. Mr.K.Balasubramaniam, learned counsel entered appearance for the respondent and submitted that he has no objection in this petition being allowed.

In view of the submission made by the learned Spl. Public Prosecutor and the reasons adduced in the affidavit filed in support of this petition, this petition is ordered and consequently, the delay in filing the appeal is condoned.
