This Writ Petition is of the year 2004 and the petitioner has sought a mandamus forbearing the second respondent, being the Divisional Engineer, National Highways Department to desist from giving efffect to his order dated 28.04.2004, which is addressed to R1/the Indian Oil Corporation Limited.
2. Learned counsel for the petitioner would agree that much water has flown under the bridge for the last 18 years when the Writ Petition has been pending on the file of this Court. The Rules and Regulations relating to the setting up and management of fuel outlets has undergone a sea change and hence, nothing survives in this matter as on date.
3. Recording the aforesaid, this Writ Petition is closed. With this, interim stay granted on 18.05.2004 stands vacated and the Miscellaneous Petition stands closed. Needless to say that any cause of action that arises from
the operation of the Regulations as on date, and that prejudice the petitioner, can always be challenged by the petitioner, in accordance with law. No costs. 19.12.2022 Index : Yes / No Speaking Order sl To
