JUDGMENT
The respective learned Counsel appearing on behalf of the Appellant as well as the respondent made a submission that the parties to the lis on hand settled the issues between them and the settlement done out of the Court was also signed by the respective parties.
2. Even in the agreement, it is stated that the Appellant will withdraw the second appeal. Such being the condition agreed upon between the parties, this Court is of an opinion that no further adjudication needs to be entertained in respect of the grounds raised in the second appeal and accordingly, the second appeal stands closed. However, there shall be no order as to costs.
