This petition is filed to condone the delay of 44 days in filing the restoration petition.
2. When the matter is taken up for hearing, the learned counsel for the petitioner would submit that the sole petitioner has died. Due to an inter-se dispute between the legal heirs, difficulties are being faced in bringing the legal heirs of the sole petitioner on record as well as in taking steps to bring on record the legal heirs of the deceased respondents 1 and 2.
3. In view of the same, this Court is not inclined to keep the petition pending.
Hence, this Civil Miscellaneous Petition is dismissed.
