PRAYER : Criminal Appeal has been filed under Section 374(2) of Criminal Procedure Code, against the Judgment passed by the Learned Magalir Judge, Special Court for cases under POCSO Act 2012/Mahila Court, Chennai 104 dated 19.01.2017 convicted him under Section 10 of the POCSO Act sentenced to undergo 5 years rigorous imprisonment and also imposed a fine of Rs.5,000/- i.d., to undergo six months rigorous imprisonment and to set aside the conviction against him.

JUDGMENT

This Criminal Appeal has been filed as against the Judgment passed in S.C.No.32 of 2015 dated 19.01.2017 by the Learned Magalir Judge, Special Court for cases under POCSO Act 2012/Mahila Court, Chennai 104, thereby convicted the appellant under Section 10 of the POCSO Act.

2. The appellant was convicted for the offence punishable under Section 10 of the POCSO Act and he was sentenced to undergo five years rigorous imprisonment and also imposed a fine of Rs.5,000/-, in default to undergo six months rigorous imprisonment.

3. The learned counsel for the appellant submitted that already the appellant had undergone the sentence. Thereafter, he was released from prison.
