O R D E R

This writ petition has been filed for issuance of a writ of mandamus directing the respondents to consider the representation made by the petitioner on 20.08.2022 wherein the petitioner has sought for revocation of the order of suspension and to give posting in a non-sensitive post.

2. Heard Mr.K.Sellathurai, learned counsel for petitioner and Mr.Ru.Dinesh Kumar, learned Additional Government Pleader, appearing for respondents.

3. The petitioner was working as a Village Administrative Officer. Based on a complaint, a FIR came to be registered in Crime No.1 of 2022 by the DV & AC, Nagapattinam, for offence under the Prevention of Corruption Act. Based on the same, an order of suspension came to be 2/4

passed by the second respondent through proceedings dated 26.02.2022. The grievance of the petitioner is that he gave a representation on 20.08.2022 seeking for revocation of the order of suspension. Since the same was not acted upon, the present writ petition has been filed before this Court seeking for appropriate direction.

4. Taking into consideration the limited relief sought for in this writ petition and without going into the merits of the case, there shall be a direction to the second respondent to consider the representation made by the petitioner on 20.08.2022 on its own merits and in accordance with law and take a decision within a period of six (6) weeks from the date of receipt of a copy of this order.

With the above direction, this Writ Petition is disposed of. No costs. 03.02.2023 Index : Yes/No Speaking order:Yes/No gm 3/4
