Writ Petition filed under Article 226 of the Constitution of India praying for issue of Writ of Mandamus, directing the

respondents herein to settle the above two housing loan dispute in a peaceful manner by adjusting the 4th respondent/ Life Insurance Corporation of India Policy No.71738898 of my husband towards the said housing loan amounts and close the two LIC loan accounts in loan account No511100001887 and in loan account No.18300000449 in the 5th respondent office once an for all by waiving the balance loan amount fully as a special case under humanitarian grounds.

O R D E R

(Order of the Court made by M.DURAISWAMY,J.) The petitioner has filed the above Writ Petition to issue a Writ of Mandamus, directing the respondents to settle the two housing loan dispute in a peaceful manner by adjusting the Life Insurance Policy of her husband towards the said housing loan amounts and close the two LIC loan accounts and by waiving the balance loan amount fully as a special case under humanitarian grounds.

2. On a reading of the affidavit filed in support of the Writ Petition, it is clear that the petitioner's husband had committed suicide. When the petitioner's husband had committed suicide, whether the petitioner is entitled to get the LIC policy amount can be decided only by Life Insurance Corporation of India. When the petitioner has got no legal right to adjust the policy amount with the LIC Housing loans, the prayer sought for in the Writ Petition cannot be granted.

3. In such view of the matter, we are not inclined to entertain the Writ Petition. Accordingly, the Writ Petition is dismissed.No costs. Consequently the connected Miscellaneous Petition is closed.
