2019-01-25Honourable Mr Justice M.M.Sundresh,Honourable Mr Justice M. Nirmal Kumar2 pages

H.C.P. No. 1082 of 2018 M.M.SUNDRESH, J.

and M. NIRMAL KUMAR, J.

[Order of the Court was made by M.M.SUNDRESH, J.] The petitioner is the father of the detenue. Alleging that she is missing and in the custody of the third respondent, the present habeas corpus petition has been filed.

2. The learned Additional Public Prosecutor submitted that she is not in the custody of the third respondent, but with somebody else with whom she has eloped. In fact, she herself has filed a Habeas Corpus Petition before the High Court of Kerala in W.P.(C) No. 1664 of 2019, which was disposed of on 19.02.2019, giving liberty to the detenue to approach this Court. It is further informed by the learned Additional Public Prosecutor that she is living in the State of Kerala, in an unknown place, with the suspect, who is also having some other case apart from the case for divorce with his estranged wife. The detenue has also begotten a girl child. Thus, we do not find any illegal detention involved.

In view of the above, no further orders are required. (M.M.S.,J.) (M.N.K.,J.) 01.07.2019 mmi/ssm http://www.judis.nic.in
