J U D G M E N T

This second appeal has been filed as against the judgment and decree passed in A.S.No.4 of 2001 dated 31.08.2001 by the Principal District Judge, Dharmapuri at Krishnagiri on appeal against the judgment and decree passed in O.S.No.454 of 1996 dated 27.09.2000 on the file of the Sub-Ordinate Judge, Hosur.

2. The learned counsel appearing for the appellant seeks permission to withdraw this second appeal and he has made the following endorsement to that effect:- "The appeal is not pressed and the same may be dismissed as withdrawn."

3. In view of the above, this second appeal is dismissed as withdrawn. No costs.
