Heard Mr.A.Sundaravadhanan, learned counsel for the petitioners; Mr.B.Anand, learned Government Advocate for the respondents 1 to 3; Mr.D.Selvaraju, learned counsel for the respondents 5 and 6 and perused the materials available on record.
2. The petitioner has come forward with this Writ Petition praying for a direction to the respondents 1 to 3 to pass orders on the representation dated 13.07.2011.
3. The grievance of the petitioner is that the land in Survey No.717/5 situated at Alamarathipatti in Mettur Taluk belongs to Mariamman and Vinayagar Temples, but a patta was issued in favour of private respondents.
4. This Writ Petition has been field based on the Judgment and Decree passed by the District Munsif Court, Mettur in O.S.No.683 of 1990 and Sub Court, Mettur in A.S.No.104 of 1999.
5. Mr.D.Selvaraju, learned counsel for the private respondents would state that in the suit in O.S.No.683 of 1990, the petitioner sought for a right of worship and the respondents have no objection. It is further contended that the respondents 4 to 6 have already filed a suit in O.S.No.7 of 2012 before the District Munsif Court, Mettur for declaration of tile and for consequential relief and unless the right is decided by the Competent Civil Court, the petitioner cannot seek for patta in favour of the Temple.
6. Mr.A.Sundaravadhanan, learned counsel for the petitioners submitted that the suit came to be filed during the pendency of the Writ Petition and taking note of the relief sought for in the suit, the petitioners have to wait till a conclusion is reached in the Civil Suit.
7. In the light of the above submissions, this Writ Petition is disposed of with liberty to the petitioners to approach the Authorities, after disposal of litigations pending before the Civil Court. There is no order as to costs. Consequently, connected miscellaneous petition is closed.
